Terms & Conditions for BerryFit

1. About BerryFit

BerryFit is a mobile app that lets you:

• Log meals by photo, voice, text, barcode or manual entry, with AI calorie and nutrient estimates
• Get a personal calorie and nutrition plan and track meals, water and weight
• Chat with Coach Berry, an AI diet coach
• Browse healthy recipes, find recipes for the ingredients you have, and create or adjust recipes with AI

BerryFit is designed for informational and lifestyle purposes only.

2. Eligibility

You must be at least 13 years old to use BerryFit.

By using the app, you confirm that you meet this requirement.

3. User Accounts

• An account is required to use BerryFit
• Keep your sign-in details secure; you are responsible for all activity under your account
• You can delete your account at any time in the app

4. Acceptable Use

You agree not to:

• Use the app for unlawful purposes
• Upload content that is harmful, offensive, or illegal
• Attempt to reverse engineer or misuse the app or AI services
• Get around usage limits or use automated tools to access the AI features
• Use Coach Berry or other AI features to create harmful content
• Interfere with app performance or security

We reserve the right to suspend or terminate access for violations.

5. AI Features & Limitations

• AI calorie and nutrient estimates are not guaranteed to be accurate and depend on photo quality, portion size and how a dish was made
• Coach Berry is an AI, not a person, and can make mistakes
• AI recipes and recipe changes are created automatically; check ingredients, allergens and cooking steps yourself
• AI features have daily and monthly usage limits
• AI features are provided by third-party AI services (Google Gemini and Anthropic Claude), as described in our Privacy Policy

BerryFit does not guarantee nutritional accuracy.

6. Medical Disclaimer

BerryFit, including Coach Berry, does not provide medical, nutritional, or health advice.

You should not rely on BerryFit for:

• Medical diagnosis
• Treatment decisions
• Dietary or nutritional prescriptions

Always consult a qualified professional for medical concerns.

7. User Content

You keep ownership of the content you add, such as meal photos, messages and recipes you create.

By using the app, you grant BerryFit a limited license to:

• Process your content to provide the service, including through our AI providers
• Store and display your content within the app

We do not use your content for advertising.

8. Data & Privacy

Your use of BerryFit is also governed by our Privacy Policy: Privacy Policy

Please review it to understand how we handle your data.

9. Service Availability

We strive to keep BerryFit available at all times, but:

• The service may be interrupted
• Features may change or be discontinued
• Maintenance or updates may occur without notice

We are not liable for service downtime.

10. Subscriptions

BerryFit is available with a Premium subscription:

• Subscriptions are monthly or yearly and renew automatically until you cancel
• A free trial may be offered; if you do not cancel before it ends, the subscription starts and you are charged
• Payment, renewal, cancellation and refunds are handled by the App Store or Google Play under their terms
• You can cancel at any time in your App Store or Google Play account settings; deleting the app or your account does not cancel it

Prices and trial details are shown in the app before you subscribe.

11. Intellectual Property

All rights to BerryFit, including:

• App design
• Logos
• Text and graphics

are owned by BerryFit or its licensors.

You may not copy or redistribute any part of the app without permission. Recipe photos are used under their own free licenses and credited in the app.

12. Limitation of Liability

To the maximum extent permitted by law:

• BerryFit is provided “as is”
• We are not liable for indirect or consequential damages
• We are not responsible for decisions made based on app content

Use of the app is at your own risk.

13. Termination

We may suspend or terminate access if:

• These Terms are violated
• The app is misused
• Required by law

You may stop using BerryFit at any time.

14. Changes to These Terms

We may update these Terms occasionally.

Updated versions will be posted with a new effective date.

Continued use of the app means acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of Finland, without regard to conflict of law principles.
